# BW Notary Service Terms & Conditions

These Terms & Conditions are designed to clearly explain how our services work, what clients can expect, and how to best prepare for a smooth notarization experience.
## 1. General Terms of Service
BW Notary Service provides mobile notary, loan signing, Remote Online Notarization (RON), apostille facilitation, estate planning document assistance, and related administrative support services.
We are not attorneys and do not provide legal advice, legal interpretation, legal representation, or legal document drafting. Nothing on this website or during any appointment should be interpreted as legal advice.
Clients are solely responsible for:
* The accuracy and completeness of their documents
* Understanding the contents of their documents
* Ensuring their documents meet the requirements of the receiving agency, lender, court, title company, employer, or other third party
* Confirming the type of notarization required
* Confirming whether witnesses are required
By booking services, clients acknowledge that a notary public serves only as an impartial witness to the signing of documents.
## 2. Florida Notary Fee Disclosure
Notarial fees for traditional notarizations and Remote Online Notarization services are governed by Florida law.
Additional charges for travel, printing, witnesses, after-hours appointments, parking, tolls, courier services, shipping, document handling, or administrative services may apply and will be disclosed prior to the appointment whenever possible.
## 3. Identification Requirements
All signers must present valid, unexpired, government-issued photo identification at the time of notarization.
Acceptable forms of identification may include:
* Driver’s license
* State-issued identification card
* Passport
* Military identification card
* Other government-issued identification permitted under Florida law
For Remote Online Notarization services, additional identity verification may be required, including credential analysis and knowledge-based authentication.
Failure to provide acceptable identification will result in the appointment being unable to proceed and may still be subject to applicable fees.
## 4. Signer Awareness & Willingness Requirements
All signers must be willing, aware, and able to communicate directly with the notary.
We reserve the right to refuse service if a signer appears:
* Coerced or pressured
* Unable to communicate effectively
* Under the influence of drugs or alcohol
* Mentally impaired, confused, or unable to understand the document being signed
* Unable to confirm their identity or intent to sign voluntarily
## 5. Document Requirements
Documents must be complete before notarization.
We will not notarize:
* Blank or incomplete documents
* Documents with missing pages
* Documents containing obvious alterations or suspicious changes
* Documents requiring legal advice or legal interpretation
* Documents prohibited by law
It is the client’s responsibility to ensure all documents are complete and ready prior to the appointment.
## 6. Witness Requirements
Certain documents, including estate planning documents, deeds, and real estate forms, may require one or more witnesses.
Clients are responsible for confirming whether witnesses are required.
Unless otherwise arranged in advance, clients are responsible for providing their own witnesses. Witness services may be available upon request for an additional fee.
## 7. Payment Policy
Payment is required prior to or at the time of service.
Remote Online Notarization services must be paid in full before the session begins.
Accepted payment methods include approved electronic payment options listed on our website.
Services will not be performed without confirmed payment.
## 8. Cancellation & Rescheduling Policy
We understand that plans change. Please review the following:
* Appointments canceled or rescheduled with less than 24 hours’ notice may be subject to a cancellation fee
* No-shows may be charged the full service fee
* Travel fees become non-refundable once the notary departs for the appointment
* Administrative, printing, witness, shipping, courier, and convenience fees are non-refundable once incurred
* Reserved appointment times are forfeited if the signer is unavailable, unprepared, lacks valid identification, lacks required witnesses, or refuses to sign
## 9. Refund Policy
Due to the nature of notarial services:
* Notary fees are non-refundable once a notarization has been completed
* Travel fees are non-refundable once the notary is en route
* Apostille, printing, witness, courier, shipping, and administrative fees are non-refundable once incurred
* Refunds will not be issued for documents rejected by third parties, incorrect document selection, incomplete documents, missing witnesses, lack of identification, client scheduling issues, or client error
If an error is made by BW Notary Service, we will take prompt corrective action at no additional charge.
## 10. Mobile Notary Travel Policy
Travel fees are based on distance, time, appointment location, parking, tolls, and scheduling considerations.
Additional charges may apply for:
* Hospitals
* Nursing homes
* Jails or detention facilities
* Airports
* After-hours appointments
* Emergency or same-day appointments
* Extended wait times
* Locations requiring paid parking or toll roads
Quoted travel fees are disclosed prior to the appointment whenever possible.
Appointment times are estimates and may vary slightly due to traffic, weather, previous appointments, parking delays, or other unforeseen circumstances.
## 11. Loan Signing Services
Loan signing appointments may include printing, travel, scan backs, witness coordination, or courier services.
Borrowers are responsible for:
* Having valid identification available
* Ensuring all signing parties are present
* Confirming whether witnesses are required
* Reviewing loan documents before signing
* Contacting their lender, escrow officer, or title company with legal or financial questions
We do not explain loan terms, interpret legal documents, or advise borrowers on whether they should sign.
## 12. Estate Planning Document Services Disclaimer
When estate planning documents or templates are purchased through our website:
* Notarization and applicable mileage are included only as stated at checkout
* We do not provide legal advice regarding estate planning decisions
* We do not guarantee that purchased documents are appropriate for a client’s individual circumstances
* Clients are responsible for reviewing all documents prior to signing
* Use of this website does not create an attorney-client relationship
## 13. Remote Online Notarization (RON) Policy
For Remote Online Notarization services:
* Clients must have a stable internet connection, a functioning camera, and audio capability
* Clients must complete any required credential analysis or identity verification process
* Failed sessions due to technical issues on the client’s end may not be refundable
* RON sessions may be recorded and stored in accordance with applicable law and platform requirements
## 14. Apostille Facilitation Disclaimer
Apostille services are facilitation services only.
Apostilles are issued solely by the appropriate government authority, including the Florida Department of State or other authorized agencies.
Processing times are estimates only and are not guaranteed.
We are not responsible for delays, rejections, or additional costs caused by:
* Incorrect or incomplete documents
* Improper notarization performed by another party
* Agency-specific requirements
* Shipping delays
* Government processing delays
Apostille fees, shipping fees, courier fees, and government fees are non-refundable once documents have been submitted.
## 15. Pre-Employment & I-9 Verification Services
Pre-employment services may include:
* Remote I-9 authorized representative services
* Identity verification
* Employment document witnessing
* Administrative coordination between employer and employee
We act only as a neutral third-party service provider.
We do not make hiring decisions, employment recommendations, immigration determinations, or eligibility decisions.
Employers are solely responsible for ensuring compliance with federal, state, and company-specific hiring policies.
We are not responsible for errors, delays, technical issues, or failures caused by employer HR platforms, onboarding systems, or third-party software providers.
## 16. Privacy Policy
Client information is kept confidential and used only for service fulfillment, legal compliance, record keeping, and communication related to requested services.
We do not sell or share personal information except when necessary to complete requested services or comply with applicable law.
Records may be maintained in accordance with applicable notary laws and record keeping requirements.
## 17. Right to Refuse Service
We reserve the right to refuse or discontinue service for reasons including, but not limited to:
* Insufficient identification
* Incomplete or suspicious documents
* Suspected fraud, coercion, or misrepresentation
* Signers who are unwilling, impaired, or unable to communicate
* Unsafe environments
* Requests outside the scope of lawful notarial services
* Inappropriate, abusive, threatening, or disrespectful behavior
## 18. Website Use & Intellectual Property
All website content, pricing, graphics, branding, forms, downloadable materials, and text are the property of BW Notary Service unless otherwise stated.
No content may be copied, reproduced, distributed, or resold without written permission.
Use of this website does not create an attorney-client relationship, fiduciary relationship, or legal advisory relationship.
## 19. Limitation of Liability
BW Notary Service’s liability is limited to the amount paid for the specific service provided.
We are not liable for:
* Document rejection by third parties
* Delays caused by client error
* Lost opportunities, missed deadlines, or consequential damages
* Government processing delays
* Employer platform failures
* Lender, title company, court, or agency requirements
* Technical failures outside our control
## 20. Governing Law
These Terms & Conditions are governed by the laws of the State of Florida.
## 21. Agreement to Terms
By booking, purchasing, or using services through BW Notary Service, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
